A Brief Overview
The Children's Hospital of Philadelphia Office of General Counsel is looking for an experienced attorney to serve as Director and Associate General Counsel, Litigation. In this role, the Director and Associate General Counsel will provide legal advice and counsel to CHOP on a wide range of legal issues that arise in the hospital and health care setting, with a focus on professional liability matters. The ideal candidate will have exceptional judgment and communication skills and will be motivated by working with leaders and other stakeholders inside and outside of CHOP in a fast-paced environment on a broad, varied and challenging portfolio of matters. The Director and Associate General Counsel is expected to work independently with minimal supervision, leveraging developed skills and experience.

What you will do
GENERAL DUTIES:
Provide legal guidance and advice to hospital leaders and other internal stakeholders on legal issues that arise in the health care setting. Provide thoughtful and sophisticated legal services on complex matters.
Work closely with organizational leaders, including executives and, at times, Board members, in addressing institutional legal and risk matters.
Work collaboratively as part of the Office of General Counsel and with clinical, administrative and research leaders throughout the organization in identifying and developing proactive and creative solutions to legal issues.
Remain current on legal developments in areas of expertise and assist organization in responding to changes in laws/regulations/legal risks.
Provide on-call legal services for urgent and emergent hospital legal matters arising outside of traditional business hours.
Prepare and present trainings to internal stakeholders on relevant legal issues.
Assign, oversee and actively manage the work of outside counsel in appropriate matters.
Perform other legal duties as may be assigned from time to time.
CLINICAL OPERATIONS:
Serve as a legal resource for clinical operations, including: direct legal support on patient care issues to the clinical staff, including custody, consent and guardianship issues.
Obtain court orders to treat where appropriate or necessary.
LITIGATION/PRE-LITIGATION:
Provide primary legal support to CHOP’s Joint Professional Liability Program, including: supervising outside counsel handling professional liability defense; overseeing investigation of malpractice claims; representing CHOP and its employees and staff in non-litigated claims, including responding to plaintiffs’ attorneys; providing strategic direction to defense of professional liability cases; overseeing preparation and presentation of cases to the Claims Review Committee; and advising on resolution and other critical decisions in the cases.
Provide legal support and oversight as needed, for CHOP’s workers' compensation, commercial, general liability, employment, and/or payor litigation, including retaining outside counsel and overseeing strategy.
Oversee and/or conduct sensitive investigations for CHOP, including in cooperation with the Compliance Department.
Provide legal and regulatory advice as requested.
Advise and represent CHOP staff, as appropriate, in connection with subpoenas, requests to testify at legal proceedings and depositions, and other matters.
Educate clients about litigation and risk prevention matters.
Requirements
Education Qualifications
Juris Doctor (JD) Law or Jurisprudence Required
Experience Qualifications
At least ten (10) years employment as an attorney Required
Experience providing advice to health care clients Preferred
Previous in-house experience Preferred
Skills and Abilities
This position requires a demonstrated capability for legal research, analysis and reasoning, strong oral and written communication skills, an ability to identify and resolve complicated and sensitive problems creatively and with professional discretion and an ability to interact and function effectively in a competitive, professional healthcare, academic and research environment. Additionally, applicants must have excellent academic credentials, a strong work ethic, the ability to organize and prioritize work and meet deadlines, and strong interpersonal skills.
